State Human Rights Commission, Mumbai
In accordance with the provision made in section 21 of the protection of Human Rights Act, 1993. The Government of Maharashtra on 15th January,2000 decided to establish the State Human Rights Commission and the Commission started functioning from 13th March, 2001 under administrative control of the Home Department, Government of Maharashtra. At present there is one Chairperson and two posts of Members in the Commission. The Commission has Secretary, one Special Inspector General of Police and one post of Registrar. The Commission has three Division (1)Legal Wing (2)Administration and (3) Investigation.In all 54 regular posts have been sanctioned for the Commission. Beside this 15 notional posts for a period of two years have been sanctioned. Thus, 69 posts have been sanctioned.The Commission has its office at 9, HazarimalSomaniMarg, Administrative Ital Staff Collage Building, opposite C.S.T. Mumbai-400 001. Commission shall perform all or any of the following function namely:
- Inquire, suo-moto on a petition presented to it by a victim or any Person on his behalf, into complaint of
a) Violation human rights or abatement thereof, or
b) Negligence in the prevention of such violation by a public servant - Intervene in any proceeding involving any allegation of violation of human rights pending before a court with the approval of such court.
- Visit, under intimation to the State Government, any jail or any other institution under the control of the State Government where persons are detailed or lodged for purposes of treatment, reformation or protection to the study the living conditions of the inmates and make recommendations thereon.
- Review the safe guards provided by or under the constitution or any law for the time being in force for the protection of human rights and recommend measures for their effective Implementation .
- Review the factors, including acts of terrorism, that inhabit the enjoyment human rights and recommend appropriate remedial measures
- Study treaties and other international instruments on human rights and make recommendation for their effective implementation.
- Undertake and promote research in the field of human rights.
- Spread human rights literacy among various section of society and promote of the safeguards available for the protection of these rights through publications, the media seminars and other available means.
- Encourage the efforts of non-governmental organization and institutions working in the field of human rights.
